Affiliate Program Policy

T&C AFFILIATE PROGRAM:

This agreement describes the Terms and Conditions for participation in the True + Luscious Affiliate Program. In this agreement, the term "Affiliate" refers to you (the applicant). In this agreement, “True + Luscious” refers to True Luscious LLC, a California Limited Liability Company, with whom you are entering this agreement. By applying to the True + Luscious Affiliate Program you are confirming that you have read the agreement and agree to the Terms and Conditions.

Neither these Terms and Conditions nor your participation in the Affiliate Program creates any employment, independent contractor, agency, partnership, or joint venture relationship between you and True + Luscious.

Eligibility

Affiliates must be at least 18 years old in order to participate in the Affiliate Program. True + Luscious reserves the right, in its sole discretion, to accept or reject any application for membership in the Affiliate Program for any reason.

Payment

An Affiliate can request a payment when their balance reaches a minimum balance of $25 USD. Payments can be requested at any time. Payment processing can take up to 3-5 business days from the request date. Payments will generally be paid out via PayPal. Payments to Affiliates will not be made via cash or check. 

Refunds

In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

Usage and Obligations

Affiliates are permitted to use the True + Luscious brand and marketing resources available in the Affiliates section of our application. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.

The Affiliate will never imply that they are acting on behalf of True + Luscious. The Affiliate will never bid for advertisements that compete with True + Luscious.

The Affiliate will never represent themselves, True + Luscious or their relationship with True + Luscious in a false or misleading way.

The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing True + Luscious.

Term and Termination

Either party has the right to terminate the agreement immediately without prior notice.

If the Affiliate terminates the agreement, no further commissions from True + Luscious will be paid for any future customer transactions. If the Affiliate has a balance owed to them on the date of termination, True + Luscious will send payment of the remaining amount owed within 7 business days of the termination of the agreement.

Governing Law

This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of California, without regard to its conflict of laws rules.

Arbitration

All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the State of California. An award of arbitration may be confirmed in a court of competent jurisdiction.

Modification

We may modify any of the Terms and Conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.
